California Leave of Absence “Boot Camp” for Texas Employers

This seminar will prepare Texas employers for the challenges presented by employee absences in California, including some of the most detailed and protective in the country.  Attendees will receive a detailed overview of the state and federal laws protecting employee absences, disability accommodation requirements, and laws protecting employees who take such leaves.  Specifically covered will be:

  • The Family and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA), and the way the two laws interact.  Covered in detail will be the dramatic expansion of the CFRA for all employers with five or more employees, requiring most employers to provide up to 12 weeks of job-protected leave
  • Leave laws that may be used to protect COVID-19-related absences, including any extension of the Families First Coronavirus Response Act (FFCRA), if it is extended past December 31, 2020
  • Wage-replacement considerations for employees on leave in California, including State Disability Insurance, Paid Family Leave (PFL), and unemployment compensation
  • Required policies and postings

Form policies will be shared, and typical hypotheticals will be reviewed along with potential compliance strategies.

  • Employee’s own serious health condition
  • Child, parent, or other family member’s serious health condition
  • Physical or mental disability
  • Baby bonding/adoption/foster care
  • Alcohol and drug rehabilitation

  • Jury duty
  • Witness testimony
  • Voting
  • Activities attributable to being a victim of domestic violence
  • Activities attributable to being a crime victim
  • Organ and bone marrow donation
  • Volunteer firefighter/reserve police officer/emergency rescue service
  • Lactation accommodation
  • Leave laws that may be used to protect COVID-19-related absences, including any extension of the Families First Coronavirus Response Act (FFCRA), if it is extended past December 31, 2020.

SPEAKER

Scott Brutocao is a licensed California attorney who has been practicing employment law in California for 25 years. He has litigated and advised employers in hundreds of matters under California law, and has been advising Texas employers under California law since he was admitted to the Texas Bar in 2000. He is board certified in Labor and Employment Law by the Texas board of Legal Specialization and has provided employee and manager training on California and Texas employment laws throughout his career.
